Let us look at a general business immigration process for a Ukrainian citizen who plans to legalize their stay in Poland through business activity.

  1. Business registration (JDG or sp. z o.o.), including remote registration.
  2. Obtaining registration documents (KRS, NIP, REGON).
  3. Entering Poland (visa-free entry or visa).
  4. The actual start of business operations.
  5. Preparing the document package.
  6. Submitting the residence card application to the voivodeship office.
  7. An interview and business verification.
  8. Waiting for the decision.
  9. Receiving the residence card.

The first card is usually issued for 1 year. If the business activity is stable, the next one may be issued for up to 3 years.

Grounds for Obtaining a Temporary Residence Permit Through Business

Polish law provides several ways to confirm the grounds for temporary residence based on business activity.

Confirmed Company Income

One option is to prove that the business already generates sufficient income. The benchmark is 12 times the average salary for the previous year.

For small businesses, this is often difficult, so in practice this path is usually used by companies that have already been operating for more than a year.

Employment of Polish Citizens

A company may confirm that it has created jobs for Polish citizens, but under strict conditions:

  • full-time employment;
  • a salary not lower than the minimum wage;
  • an indefinite-term employment contract.

This option is mainly suitable for medium-sized and large businesses.

Proving the Business Potential

The most common option for new companies is to show that the business is capable of reaching the required indicators in the future.

  • a realistic business plan;
  • investments in the project;
  • equipment, tools, and resources;
  • contracts or letters of intent.

Obtaining a Residence Card on the Basis of Business: Step by Step

Step 1. Choosing the Type of Activity

The type of activity must be thought through in advance. The voivode assesses not the idea itself, but its viability in Polish realities.

Step 2. Entering Poland

For Ukrainians, visa-free entry for the purpose of running a business is possible. It is important to have proof of your grounds already at the border.

Step 3. The Actual Start of Activity

  • renting an office or workplace;
  • signing an agreement with an accounting provider;
  • registration with ZUS and the tax office.

Step 4. Collecting Documents

The required package includes:

  • the residence card application;
  • 4 photographs;
  • a passport and copies;
  • health insurance;
  • proof of accommodation;
  • business documents;
  • proof of income.

The government fee for reviewing the application is 340 PLN.

Step 5. Proof of Income

Income is confirmed not for the company, but for the applicant:

  • for yourself — not less than the established social minimum;
  • separately — for dependents.

For newly established companies, income may be confirmed through other legal sources.

For a residence card through business, it is important to show not only the company itself, but also the applicant’s real ability to support themselves while living in Poland.

Step 6. The Interview

This is a key stage. The entrepreneur effectively “defends” their business before the urząd, proving its value to the Polish economy.

Validity Period of the Card and Renewal

In most cases, the first card is issued for 1 year. The next one may be issued for up to 3 years, provided there are real financial results.

Permanent Residence and Long-Term Stay

It is not possible to obtain permanent residence directly through business. However, after 5 years of legal stay, you may apply for the EU long-term resident card.
