Work-Based Residence Permit in Poland:
how the process works step by step
A temporary residence permit based on employment allows you to legally live and work in Poland for an extended period without the need to obtain a new visa.
It grants the right to:
- official employment with a specific employer;
- legal residence in Poland for up to 3 years;
- free entry to and exit from Poland without additional visas;
- opening bank accounts, renting accommodation, and obtaining insurance;
- subsequent application for a permanent residence permit or EU long-term resident status.
A work-based residence permit is issued to foreigners who have official employment in Poland and meet the legal requirements.
Main grounds:
- Employment contract (umowa o pracę) — the standard form of employment;
- Civil law contracts (umowa zlecenie, umowa o dzieło);
- Employment with a Polish company with a valid work permit;
- Change of employer — provided that the required procedure is followed;
- EU Blue Card — for highly qualified specialists.
The procedure for obtaining a work-based residence permit consists of several mandatory stages:
- Situation and grounds analysis. We review the employment contract, type of work, and the employer’s documents.
- Preparation of the document package. Application form, contract, attachments, proof of income, and insurance.
- Submission of the application to the voivodeship office. Appointment booking and personal submission of documents.
- Case review. Verification of documents and legal grounds (takes several months).
- Issuance of the residence permit card. The card is issued for a period of up to 3 years.
Obtaining a work-based residence permit is a legally complex process where mistakes can lead to delays or refusal.
We provide:
- accurate determination of the appropriate legal grounds for your specific situation;
- a complete and correctly prepared set of documents;
- full support at every stage of the procedure;
- minimization of the risk of refusal;
- consultations in Ukrainian and Russian.

What is a work-based residence permit?
Work-based residence permit (in Polish: karta pobytu na podstawie pracy) is a plastic card that confirms your right to legally reside in Poland and perform work under specific conditions. In everyday use, it is often referred to as a “residence permit,” but it is important to understand the distinction: the legal force lies in the decision issued by the voivode (decyzja administracyjna), while the card itself is a document used conveniently in daily life and during travel.
A residence permit card performs two key functions:
- it identifies a person in Poland (similar to the Polish *dowód osobisty*, but for foreigners);
- it confirms the legality of stay and the grounds for residence.
When crossing the border, the residence card must be presented together with a passport. The plastic card is required in many situations — at banks, when renting accommodation, arranging services, and dealing with public institutions.
Who a temporary work-based residence permit is suitable for
A residence permit based on employment is suitable for foreigners who:
- are officially employed in Poland (under a contract);
- have valid legal grounds for employment and documented working conditions;
- wish to legalize their stay for a period ranging from several months up to 3 years (depending on the situation and documents).
For how long a work-based residence permit is issued
The validity period of the residence permit depends on your individual situation, the type of employment contract, and supporting documents. Most commonly, the permit is issued for up to 3 years, but not longer than allowed by the legal grounds (for example, the duration of the contract, work permit, or other circumstances).
Important: a temporary residence permit is not “automatically extended.” If you plan to continue living and working in Poland legally, you must apply again when necessary.
How to obtain a work-based residence permit: step by step
1) Determining the grounds and verifying documents
At the initial stage, it is essential to correctly determine the legal grounds for your application: umowa o pracę, umowa zlecenie, other possible options, as well as whether additional documents are required (work permit, insurance confirmation, employer’s details).
This stage is where mistakes most often occur: inconsistencies in contracts, different salary amounts in documents, outdated permits, or incorrectly completed forms.
2) Preparation of the application package
Next, the document package is prepared according to the specific voivodeship and your individual situation. For a work-based residence permit, the following documents are usually required:
- application form (*wniosek*) for temporary residence;
- photographs (3.5 × 4.5 cm);
- confirmation of payment of the state fee;
- passport and copies of its pages;
- employment contract;
- confirmation of insurance / ZUS contributions (depending on the type of contract);
- *Załącznik No. 1* from the employer (in many cases);
- employer’s documents (CEIDG/KRS, etc.);
- other documents required for the specific case.
The list may vary — which is why generic “templates from the internet” often do not work.
3) Submission of the application (in person / via office / by post)
The key rule is that documents must be submitted no later than the last day of legal stay in Poland.
The method of submission affects practical details: after submission, you may be summoned to provide fingerprints and present original documents.
4) Passport stamp and legal stay during the process
After successful submission (and completion of formalities), in many cases a stamp is placed in the passport confirming that the review process has started. This stamp does not guarantee a positive decision, but it allows you to legally stay in Poland during the procedure — provided that all rules are followed.
5) Decision (*decyzja*) and issuance of the residence card
After a positive decision is issued, you receive the decyzja, followed by the plastic residence card itself. In some cases, additional time may pass between the decision and receipt of the card (queues, production time).
Is a work-based residence permit tied to the employer and what to do when changing jobs
One of the most common issues is a change of employer. In many situations, the law requires notifying the relevant office (urząd) of changes related to employment: termination of employment, transition to another company, or changes in working conditions. Deadlines may vary depending on the legal grounds and your specific decision.
Most importantly: do not ignore the obligation to notify the authorities. This affects future applications, decisions, and the security of your legal status in Poland.
How to increase the chances of a positive decision
To ensure that the process of obtaining a work-based residence permit goes smoothly, it is important to:
- prepare a complete set of documents;
- avoid errors in personal data, dates, addresses, and income amounts;
- monitor correspondence from the office and comply with response deadlines (often 7–14 days);
- provide a correct correspondence address to avoid missing important requests.

Questions and Answers about the Work-Based Residence Permit
Yes, you can. If you are legally staying in Poland and have valid grounds for employment (an employment contract or confirmation of work), you are entitled to submit your application immediately, without waiting several months. The key requirement is to file the application before the end of your legal stay.
This depends on your individual situation and the legal grounds for your stay. In many cases, working is allowed if you have a valid work permit or if you are exempt from obtaining one under the law. The mere fact of applying for a residence permit does not automatically grant the right to work — each case must be assessed individually.
Leaving Poland is possible, but it involves certain risks. If you do not have a valid visa or visa-free status, the mere fact that your residence permit application is under review does not guarantee re-entry into Poland. Before traveling abroad, it is strongly recommended to seek professional advice to avoid losing your right to stay.
Yes, it does. If your address changes, you are required to inform the voivodeship office handling your case. An incorrect or outdated address may result in you not receiving an important letter from the office and missing the deadline for submitting additional documents.
Yes, you can, but the validity period of the residence permit will usually not exceed the duration of the employment contract. If the contract is concluded for only a few months, the residence permit may also be issued for a shorter period. In such cases, it is important to properly assess the feasibility of applying and consider possible next steps.
You must provide the requested documents within the specified deadline — usually 7 or 14 days. Ignoring the request or responding late often leads to a negative decision. That is why it is important to continuously monitor correspondence and respond promptly to the inspector’s requests.
Yes, it can. Even if everything is properly prepared on your side, the office also verifies the employer — including the absence of ZUS debts, the legitimacy of the company, and compliance with employment conditions. Issues with the employer’s documents are one of the common reasons for delays or refusals.
Yes. In the event of a negative decision, you have the right to file an appeal within the time limit specified by law. It is important to understand the reason for the refusal and prepare a well-argued position. In many cases, a properly prepared appeal allows the decision to be changed to a positive one.
It is not possible to buy a residence permit as a ready-made document — a residence permit is not sold and cannot be issued without an official legal procedure. Any offers to “sell a ready residence card” or provide a “fast permit without documents” are illegal and may have serious consequences.
At the same time, in everyday language the word “buy” is often used to mean paying for a legal service related to obtaining a residence permit. In this sense, it refers not to purchasing the document itself, but to professional assistance: analysis of the legal grounds, preparation of documents, submission of the application, and monitoring the process until an official decision is issued.
This is the only lawful way to obtain a work-based residence permit in Poland — through state authorities, based on genuine employment and properly confirmed documents.
