Family Reunification in Poland is a general term covering various legal mechanisms that allow family members of a foreigner or a Polish citizen to legalize their stay in the territory of the Republic of Poland.

It is important to understand that, from a legal perspective, there is only one classic ground that is directly considered family reunification. However, in practice this term is often used to describe any way of legalizing relatives. Because of this, many applicants choose the wrong legal basis, prepare an incorrect set of documents and, as a result, receive a refusal to issue a residence card.

Who has the right to family reunification in Poland

Family members who may apply for legalization include:

  • a husband or wife (both in an official marriage and in a civil partnership, provided there is evidence);

  • parents or guardians of minor foreigners with refugee status or subsidiary protection.

Important: family members must be citizens of countries outside the EU.

Parents do not always fall under the classic family reunification procedure. However, there are real chances to legalize their stay if it can be proven that:

In addition, one of the following grounds is required:

  • Polish citizenship;
  • a permanent residence card (PR);
  • a temporary residence card held for at least 2 years;
  • a residence card issued on the basis of scientific activity;
  • an EU Blue Card;
  • or submission of documents simultaneously together with family members.

How a residence card is issued for a child

Children may obtain either temporary or permanent residence.

Permanent residence is possible if the child was born when:

  • one of the parents already held permanent residence;
  • or held temporary residence and subsequently obtained permanent residence.

In other cases, a temporary residence card is issued.

If one of the parents is a Polish citizen, the child may be eligible for Polish citizenship.

Validity period of the residence card for family members

A residence card for relatives is issued for a period that does not exceed the validity of the inviting person’s residence card:

  • minimum — 3 months;
  • maximum — up to 3 years.

The longest periods are usually granted to family members of Polish citizens or permanent residence holders.

Examples of family reunification in Poland

  1. Spousal reunification
    The husband works in Poland and holds a residence card. The wife moves to Poland without the intention to work.
  2. Children joining their parents
    Children are added to one of the parents’ residence cards and may legally live and study in Poland.
  3. Civil partnership
    Without a marriage certificate the chances are lower, but still possible if there is evidence of cohabitation and a shared household.
